Terms of Service
1. Purpose
These General Terms and Conditions of Use and Sale (hereinafter the "GTC") govern the contractual relations between the online store XIBORA (operated by LAF RENO, a micro-enterprise registered under SIRET number 92115055300029, represented by Mickaël LAFONT, chemin des Iris, 26200 Montélimar, France) and any customer wishing to make a purchase via the website xibora-sports.com.
Any order placed on this site implies full and unreserved acceptance of these GTC.
2. Products
The products offered for sale are sports and sportswear items (shorts, t-shirts, accessories, etc.). XIBORA strives to present the essential characteristics of each product (description, photos, sizes) as accurately as possible. In the event of an error or omission, XIBORA cannot be held liable.
The photographs and visuals presented on the site are provided for information purposes and are not contractually binding.
3. Pricing
Prices indicated on the site are expressed in euros (€), inclusive of all taxes (TTC). XIBORA reserves the right to modify its prices at any time, it being understood that the price applicable to the order is the one in effect at the time of its validation.
4. Ordering
To place an order, the customer selects the desired products, adds them to their cart, and then validates their order by providing their delivery details and proceeding to payment. The order is definitively recorded after confirmation of payment. A confirmation email is sent to the customer at the address provided during the order process.
XIBORA reserves the right to cancel or refuse any order in the event of a dispute regarding a previous payment or suspicion of fraud.
5. Payment
Payment is made online securely. Accepted payment methods are those offered during the ordering process (credit card, etc.). The customer's banking data is encrypted and is not retained by XIBORA.
6. Delivery
XIBORA delivers to metropolitan France, Belgium, Switzerland, and Luxembourg. Two delivery options are available:
- Standard Delivery (free): estimated delivery time of 5 to 8 working days from order confirmation.
- VIP Delivery — €8.80 (with loss, breakage, and theft insurance): estimated delivery time of 3 to 5 working days from order confirmation.
These deadlines are provided for information purposes. They may vary depending on the shipping origin (France or international) and carrier lead times. In the event of a delivery delay, XIBORA cannot be held responsible.
In the event of a package lost or damaged during transport, customers who have subscribed to VIP delivery benefit from coverage by the included insurance. For standard delivery, XIBORA will study each situation on a case-by-case basis.
7. Right of Withdrawal
In accordance with articles L.221-18 et seq. of the Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to provide reasons or pay penalties.
To exercise this right, the customer must notify XIBORA of their decision by email at contact@xibora-sports.com before the withdrawal period expires.
Products must be returned in their original condition (unworn, unwashed, with tags) to the following address: LAF RENO – XIBORA, Chemin des Iris, 26200 Montélimar, France.
Return shipping costs are the responsibility of the customer. Upon receipt and verification of the returned package, XIBORA will proceed with a full refund of the order amount (excluding return costs) within 14 days, using the payment method used during the purchase.
Exception: The right of withdrawal does not apply to personalized or unsealed products.
8. Legal Guarantee of Conformity
All products sold on xibora-sports.com benefit from the legal guarantee of conformity (articles L.217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code), for a period of 2 years from delivery.
In case of a detected lack of conformity, the customer may request the repair or replacement of the product, or failing that, a refund, by contacting XIBORA at contact@xibora-sports.com.
9. Liability
XIBORA cannot be held liable for indirect damages resulting from the use of products sold on the site, nor for delivery delays due to external circumstances (strikes, bad weather, etc.).
10. Protection of Personal Data
Personal data collected during the order is processed in accordance with our Privacy Policy and the GDPR.
11. Applicable Law and Disputes
These GTC are subject to French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the French courts shall have exclusive jurisdiction.
In accordance with articles L.616-1 and R.616-1 of the Consumer Code, the customer may use a consumer mediator free of charge. You may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
